The following are Terms and Conditions for the sale of product(s) that will govern any contract of sale that we enter into with you. Please read these Terms and Conditions carefully.

These Terms and Conditions inform you of the rights and obligations that you have. Please ensure that you read this information carefully. You may also have additional rights by law, and these Terms and Conditions do not affect any additional rights. This does not affect your statutory rights as a consumer.
Throughout this document, purchasers and or potential purchasers will also be referred to as “Customers” and or “Clients” and or “You”.
IMPORTANT: These Terms and Conditions do not apply to trade clients whom are using the online ordering platform to place orders. Your Trade Terms and Conditions apply, and a copy is available upon request.

If you have any complaints in relation to our standards of service, or in relation to the purchase of product(s) from us, please contact us via email, as this will allow you a greater opportunity to provide us with details regarding the nature of your communication.
A4) The Spartan Safety Ltd internet sales team operate during the hours of 8:30am to 4:00pm Monday to Friday. Orders and
or enquiries received after these hours will be processed the next working day.
B. Purchasing from us: What you need to know
B1) In order to purchase from Spartan Safety Ltd you must be over the age of 18 and be resident in the United
Kingdom, Southern Ireland or Northern Ireland. Please note that our delivery service covers the United Kingdom and both
Southern and Northern Ireland, therefore we can only ship product(s) to these destinations.
B2) By submitting your order to us you are offering to purchase product(s) from us, therefore allowing us to use your personal
details for the purpose of supplying the required product(s). This further includes forwarding your details onto couriers who
may contact you with respect to your delivery, and or other subcontractors who may provide support with respect to
product(s) which you have purchased.
B3) We will not use your personal details for any other purpose without first seeking and gaining your consent.
You are entitled to have your details removed from our systems by writing to us at the afore-mentioned address, or emailing us at firstname.lastname@example.org and advising that you require us to remove your details. If you have requested to receive promotional offers sent to you via email and then change your mind, you can unsubscribe from this service by clicking the “UNSUBCRIBE” link on the email flyer.
B4) We are not obliged to supply the product(s) to you until we have confirmed acceptance of your order. Only when we
confirm acceptance of your order, do we enter into a contract. Automated emails, detailing the receipt of your order are not
deemed as acceptance, and you will not be the owner of the product(s) until we have received payment in full.
B4a)Spartan Safety Ltd do not supply product(s) on a sale or return basis.
B5) In the event that you discover that you have made an error with your order, please ensure that you contact us via email as
soon as possible at email@example.com before we confirm your order. Please note that Clause A4 will still apply if your
enquiry is out of our normal operating hours.
B6) Prices are checked on a regular basis, however in the event that we discover that the price of your required product(s) has
changed when your order has been received, we will contact you in order to ascertain if you wish to proceed with the

amend the price stated on the website and or any other typographical, clerical and or other omission, on the website and or
any other publication and or promotional campaign, at any time.
B8) VAT is charged on all prices (including carriage) unless the product(s) has a VAT exemption. Prices shown excluding VAT
are for guidance only and no accuracy is intended. VAT is added when your item is placed in the virtual shopping basket.
When viewing the virtual basket, product(s) shown will include VAT. When you reach the “Checkout” stage of your purchase,
the total VAT calculation is shown accordingly.
B9) Purchases made via the Spartan Safety Ltd website can be paid for via our secure internet payment systems which are
operated by third parties. Please ensure that you complete the payment process in full. Failure to do so will result in the
payment not being processed and the non despatch of goods. We do not store your credit or debit card information, therefore
if you wish to make a further purchase, you may be asked to re-enter your credit card or debit card details (unless you have a
are a PayPal Account holder and have chosen to make payments via PayPal).
If you would like to make a purchase but prefer not to do so via our website, please contact us using the information provide in
section A3 of these Terms and Conditions.
Please do not email, fax us, or send via post your credit or debit card details as we will not accept any liability for loss and or
theft of any data sent to us via these means. We will contact you via telephone in order to obtain these details if required. It is
also important to note that carriage costs for orders placed via email or telephone may vary from carriage costs for orders
placed via our website.
B10) For products which are out of stock, we will provide you with approximate delivery dates, however actual delivery dates
are not within our control and all dates provided will be estimations only. We will advise you of any alternative products
(subject to availability).
B11) Promotional discounts via the Spartan Safety Ltd online store or any other Spartan Safety Ltd website, do not apply to
delivery costs. Delivery costs will remain unaffected by any promotion unless otherwise specified.
B12) Promotional discounts via the Spartan Safety Ltd online store or any other Spartan Safety Ltd website, do not apply to
discounts which have been applied and are being received by account holding/active credit facility customers.
B13) Spartan Safety, only supplies products from reputable and established manufactures of Personal Protective Equipment. It is important to note that manufacturers reserve the right to alter the design and or specifications of any products that they supply, without prior notice. This includes changes in the materials used. Please note that although the design and or the materials used may be altered and or changed either in part or in full, each product will continue to conform to the required EN Standards and to RIS 3279-TOM (where applicable) and will be certified accordingly.
B13a) All products which Spartan Safety Ltd supply, are tested by the manufacturers to ensure that they either meet or exceed the required standard, and are then certified accordingly. This is the responsibility of the manufacturer and not Spartan Safety Ltd, therefore Spartan Safety cannot accept any responsibility for any errors and or omissions made by the manufacturer.
B13b) The customer's attention is specifically drawn to the manufacturers' brochures and safety literature in respect of the correct use and application of products which Spartan Safety Ltd may supply. The customer shall be wholly responsible for checking that such products are entirely appropriate for the use and application to which they may be put. The specification and description of the goods on our website have been supplied by manufacturers and were correct to the best of the Company's knowledge at the time of being published. In view of the rights claimed by manufacturers to change specification without notice and whilst all reasonable care is taken to ensure that due notification of such change is given customers are advised to check the exact specification of all goods PRIOR TO ORDER where variations will be material to performance.
B14)The colour reproductions of the garments featured in both our printed and or online publications are as accurate as the printing or electronic process will allow.
B14a) Spartan Safety Ltd, work with multiple of reputable and established manufacturers and suppliers. We may have multiple suppliers for a single product which in turn means that when ordering from us, the product we send you may not be identical to the image of the product represented on the website, but will meet all of the required EN standards of the original product and will be certified accordingly.
B15) Please note that when ordering items of clothing and or footwear from the website, ensure that you order the correct size (for clothing please refer to the measuring guide). Please note that if you are returning items of clothing and or footwear because they are the incorrect size, you will be responsible for paying the cost to return the goods to us for exchange, and also the cost for redelivery of the replacement goods back to you.
B16) Spartan Safety Ltd accepts no responsibility for the loss and or damage of goods in transit being shipped back to us by customers requiring exchanges, as this is the responsibility of the carrier service selected by the customer.
B17) Personalised goods cannot be accepted back into stock unless there is a proven manufacture defect. Spartan Safety Ltd reserves the right to send any goods which customers have returned as faulty to the manufacturer for inspection and or analysis and on receiving a report from the same, will inform the customer of the any decision.
C1) We inspect all goods thoroughly before packaging and shipping.
C2) We will endeavour to acknowledge all questions and or queries within a maximum period of 48 hours, from
Monday to Friday, 8:00am to 4:00pm.
C3) Delivery timescales can vary between 1 and 10 working days (based on the delivery option you have selected).
In the event that we can despatch the product(s) before the estimated time, we will notify you accordingly. Where next day
delivery is indicated, orders must be placed by 12:00 noon Monday to Thursday in order to be delivered the following day. We
do not provide a weekend delivery option, therefore orders received after 12:00pm on a Friday may not be processed and or
despatched and or delivered until the following Monday. For all orders, on delivery of the product(s), a signature will be
required by the carrier.
For orders received on weekends, these will not be processed until the Monday, unless the Monday is a Bank Holiday. Orders
placed on a Bank Holiday or over a prolonged public holiday period, will not be processed until the next working day.
C3a) Our carriers will require a signature on delivery. In the event that there is nobody available to sign for the delivery, the carrier will leave a card instructing the customer how to arrange re-delivery or collection of any goods. Alternatively if the in full customer has supplied a contact telephone number, the carrier may contact you via SMS or call you in order to either provide an update with respect to the delivery and or if the customer was not available, then to possible reschedule the same. It is then the customers’ responsibility to contact the carrier to make arrangements for redelivery or collection. Spartan Safety Ltd shall not be liable for any loss of business, including loss of profits (whether direct or indirect), business data, revenue, goodwill, or incidental, or consequential loss that you may suffer as a result of customers not being available to sign for and or not rearranging delivery and or collection.
C4) We aim to deliver product(s) to you within the timeframes indicated, however we cannot provide an exact delivery date
due to factors which may be beyond our control. This includes but is not limited to; Carrier Vehicle Breakdowns, Road Traffic
Accidents, Traffic Congestion and Adverse Weather Conditions. Refunds based on failure to deliver on time will not be
C5) We may also ship products to you in more than one consignment and in the event that this issue does occur we will first
seek your approval. There may additional delivery costs for this service, and if this is the case, you will be notified of additional
costs before the order is processed.
C5a)In the event that we have not delivered the product(s) within 10 working days of the expected delivery date, and this has
been confirmed by our carriers then you may terminate the contract, and we will issue you with a full refund.
This excludes non-delivery of items based on
a) no person is available to sign for them
b) you do not re-arrange delivery of non delivered goods with the designated carrier.
C6) Any discrepancies in relation to your product(s) must be reported to us immediately and within a maximum of 48
hours of receipt of goods. We appreciate that on some occasions, discrepancies will not be discovered until after our
trading hours as highlighted in Clause A4. If this is the case we recommend that you inform us of the details of the
discrepancy as soon as possible via email to firstname.lastname@example.org
C7) There are different delivery options available. Customers are advised to ensure that they double check the selected
delivery option. Once goods have been despatched we are unable to change the selected option. Spartan Safety cannot accept
any responsibility to delays in delivery based on the customers selected delivery option. Delivery options are subject to VAT.
Prices for delivery to both Northern and Southern Ireland will be quoted separately. If delivery is required to any of these
destinations, please contact us before placing your order via the details provided in Clause A3.
C7a) Deliveries will only be made to a single address. Deliveries for orders which require delivery to multiple addresses will
incur additional costs. You will be notified of additional costs before the order is processed.
C8) Please note that the delivery charge may not appear on your confirmation, however it will appear on the invoice which will
be despatched with your product(s).
C9) The delivery charge stated is for mainland United Kingdom orders only. Please contact us for details of delivery costs to
non-mainland destinations before placing your order.
C10) In the event that you contact us for specific details of delivery costs and agree to pay for the same, these additional
charges may not be charged on the website, and we may issue you with a separate invoice for the same. This includes non-
mainland deliveries and or requests for special and or next working day delivery.
C11) You can contact us via email (email@example.com) with any enquiries in relation to non-mainland delivery.
D. Damaged or defective goods and returns
D1) We will supply goods that are free from defects in materials, which come with the manufactures warranty. Warranties
are generally 12 months, however this is dependent on the nature of the product, and commences from the date of receipt.
D2) Please ensure that you inspect the goods when you receive them for any defects or damage. In the event that any damage
or defects are discovered, please ensure that you inform us immediately to allow for their return to us or the manufacturer.
Any cost incurred in the return of the product will be assessed and agreed at the time, and either party may be required to pay
postage costs, based on the nature of the return.
D3) We must be notified of any damaged or defective goods within 24 hours via email to firstname.lastname@example.org
D4) In the event that of any issue leading to a return of product(s), Spartan Safety will issue you with an RMA
(Return Merchandise Authorisation) code and documentation. Returns will not be processed without the RMA number and
documentation. Either party may be required to pay postage costs, based on the nature of the return.
Please read Section G of these Terms and Conditions for more detailed information.
E. Business Customers
E1) In the event that you are a business purchasing products from us, or if the products are to be used either wholly or in part for business purposes, we shall not liable to you for any loss of business, including loss of profits (whether direct or indirect), business data, revenue, goodwill, or incidental, or consequential loss that you may suffer as a result of the purchase of product(s) from us.
F. Other Information
F1) We recommend that you retain a copy of these terms and conditions for your own information.
F2) We further recommend that you retain any and all information in relation to your transaction for your information,
as we may not have access to copies at a later stage.
F3) As a consumer you have the right (in addition to your other rights) to terminate the contract and receive a refund. It is
important to note that in the interests of both health and safety, certain products sold on this website are non-refundable and
non exchangeable – this includes but is not limited to products such as respiratory equipment, first aid kits, track circuit clips,
fog signals and other products where safety may have been compromised by use and are often unfit for return. Advice must be
sought from Spartan Safety Ltd before returning them.
F4) You must inform us in writing of your intent to terminate the contract within 7 (Seven) workings days, commencing from
the day that the product(s) were delivered to you. These must be unused, unopened and in their original packaging. On
notifying us of your intent, we will send you RMA documentation. Returns without this documentation will not be accepted.
You will be responsible for the cost of returning the product(s) to us.
F5) You must return the product(s) to us at your cost, and we strongly advise that the products(s) are adequately insured
during any return journey. If you have not returned the product(s) within 14 (fourteen) days of cancellation, if requested we
can arrange for collection of the product(s) at your cost. The cost will be payable before we make arrangements for the
product(s) to be collected.
F6) For product(s) which we agree to accept back into stock, there will be a 30% re-stocking charge.
F7) We retain the right to periodically send you email and or SMS Text Messages and or Post in relation to special promotional
offers. Should you not wish to receive any information on special promotional offers, please contact us in order to unsubscribe.
G. IMPORTANT INFORMATION: PLEASE READ CAREFULLY
G1) You have the right to terminate this contract for no reason at all without penalty. It is important to note that if you have
paid by credit or debit card and then wish to terminate the contract, any refund charges made by the card processing company
will be passed on to you and deducted from the total refund amount. We will advise you of any costs prior to processing the

Please ensure that you comply with all of this section of the terms and conditions when returning unwanted product(s). Returns cannot be processed until you receive confirmation from us in the form of RMA documentation.
G5) We reserve the right to change our registered office address, our trading address.
G6) We further reserve the right to amend these terms and conditions at any time without prior notification.
H: Limitation and Liability - Force Majeure
H1) We will use all reasonable endeavours to carry out our obligations within a reasonable period of time but will not be liable
to you for any loss, costs or expenses arising directly or indirectly from any delays in doing so and we will not be deemed to be
in breach of these Terms and Conditions by reason of any delay in performing, or any failure to perform, any of our obligations
in relation to these terms and Conditions, if the delay or failure was due to any cause beyond our reasonable control. Without
prejudice to the generality of the foregoing, the following will be regarded as causes beyond our reasonable control which are
listed below including but not restricted to the following:
H2) Any other liability shall be limited to the price paid for the goods.
H3) We do not exclude our liability for fraud or for personal injury or for death, and we will not be liable to you for any
loss of profit or any indirect special or consequential loss, damage, costs, expenses or other claims, which arise out
of or in connection with the supply of goods other than as a result of a breach of an obligation arising under the Sale
of Goods Act 1979 (as amended) and/or the Supply of Goods and Services Act 1973.
H4) Spartan Safety Ltd do not accept any liability to damage of property and or for any personal injury based on the misuse of any products purchased from Spartan Safety Ltd.
H5) Spartan Safety Ltd do not dispense any Health and Safety advice. We strongly advise that if you are unsure of what type of product(s) are needed for any specific task and or working environments, that you speak to your company Health and Safety Officer and or Representative or obtain the advice of a registered and or qualified Health and Safety professional.
